Winkie terms of use

1. Who provides Winkie
Winkie is software by x3system di Giorgio Corrente («x3system»). For any communication: giorgio.corrente@x3system.it.
2. Subject
x3system grants the account that bought the uses a non-exclusive, non-transferable licence to use Winkie to set up scan-to-folder on the account's PCs and printers. Uses are bought and spent as shown in the customer area. The licence does not include the source code or the right to modify, decompile, resell or assign the software, except where the law expressly allows it.
Winkie is intended for businesses and professionals: whoever installs it declares they act within their trade or profession.
3. Software provided «as is»
Winkie is provided «as is» and «as available». To the extent permitted by law, x3system gives no express or implied warranties, including fitness for a particular purpose or uninterrupted or error-free operation, and does not guarantee that a given printer model, firmware or network is compatible. Before relying on Winkie for daily work, the user checks that it works with the wizard's test scan.
4. Limitation of liability
To the extent permitted by law, and without prejudice to article 1229 of the Italian civil code on wilful misconduct and gross negligence, x3system's total liability to the account for any cause is limited to the amount the account paid x3system for Winkie in the twelve months before the event that gave rise to it.
x3system is not liable for indirect or consequential damage, loss of profit, loss or corruption of data, scans not delivered, lost or incomplete, wrong or altered printer or network settings, or interruptions caused by third parties (network providers, printer makers, Windows updates).
5. User obligations
The user runs Winkie only on printers and networks they are entitled to configure, with lawfully obtained administrator credentials; keeps a copy of the printer's address book if they need to be able to restore it; and keeps their customer-area credentials safe.
6. Independence from the manufacturers
Ricoh is a trademark of Ricoh Company, Ltd. and Kyocera is a trademark of Kyocera Corporation; Lanier, Nashuatec, Gestetner, Rex-Rotary, UTAX, Triumph-Adler, Olivetti and d-Copia are trademarks of their respective owners. Winkie is an independent x3system product: not affiliated with, endorsed by or supported by any of these manufacturers.
7. Updates
Winkie may download and install digitally signed updates published by x3system automatically. An update may change, add or remove features.
8. Telemetry
Winkie sends x3system anonymous data about how it runs: version, Windows version, the state of scan reception, printer brand, warnings and counts of scans received and address-book updates, with a random code that does not identify the PC. Never addresses, names, paths, files or licences. Telemetry is on by default and can be turned off at any time from the wizard or the Winkie menu; details are in the privacy notice.
9. Privacy
The account's personal data is processed as described in the privacy notice: https://winkie.it/privacy/
10. Duration and suspension
These terms apply while Winkie is installed or the account has uses available. x3system may suspend a licence if these terms are breached or payment is not made. Uses bought and not spent are not refundable, unless otherwise agreed or required by law.
11. Changes
x3system may update these terms; the new version is published at https://winkie.it/condizioni/ and applies to purchases and installations after publication.
12. Governing law and venue
These terms are governed by Italian law. The courts of Modena have exclusive jurisdiction over any dispute.
